DÖNÜŞÜM EKONOMİLERİNDE REKABET POLİTİKALARININ VE HUKUKUNUN ÖNEMİ

Öz:
Bu çalışmanın konusu, dönüşüm ekonomilerinde rekabet politikaları ve hukukunun önemidir. Betimleyici bir yöntemle yürütülen çalışmada, ülke ya da sektör sınırlaması yapılmamıştır. Konunun önemi tartışıldıktan sonra, karşılaşılan başlıca engellerin devlet bürokrasisi, rüşvet ve organize suçlar, hukuki altyapı eksikliği, uzman eksikliği, rekabetçi iklim ve kültür eksikliği olduğu belirlenmiştir. Dönüşüm ekonomilerinde etkili bir rekabet politikası ve rekabet hukuku uygulaması için; rekabet hukukunun aşamalı bir şekilde uygulamaya konulması; rekabet politikalarının diğer ekonomik politikalarla bir bütünlük oluşturacak şekilde uyumlu olması; rekabet hukuku uygulamasının uzmanlaşmış kurumlar ya da mahkemeler tarafından yerine getirilmesi; kurumsal bir altyapının oluşturulması ve piyasa ekonomisi ve rekabetin unsurlarının kamuoyu ile paylaşılması önerilerinde bulunulmuştur.

Öz:
The subject of this study is to evaluate the importance of competition policies and competition law in transition economies. The study held by a descriptive method and carried out without any restriction of country or sector. After discussing the importance of the subject it is determined that the major obstacles of transition are state bureaucracy, corruption and organized crime, lack of legal infrastructure, lack of specialist and deficiencies of competitive climate and culture. In transition economies, for an effective competition policy and competition law to be enforced these suggestions are made: an incremental implementation of competition law; integrity and consistency of other economic policies with competition policy; competition law enforcement by specialized agencies or the courts; establishing institutional infrastructure and sharing the market economy and competition elements with the public.
