Nefret söylemi ifade özgürlüğünün neresinde?
Öz: Bu yazı tartışmalı bir kavram olan nefret söylemini bir insan hakkı olan ifade özgürlüğü ile ilişkisi bakımından ele almayı ve bu bakımdan kavramın tanım, içerik ve uygulama alanını aramayı amaç edinmektedir. Bu anlamda kavramın; hangi ifade ve eylemleri tasvir etmek adına kullanıldığı, ifade özgürlüğü ile olan ilişkisinde nerede konumlandırıldığı ve bu konumlandırmanın neyi esas alarak gerçekleştirildiği konu edilecektir. Nefret söylemini açıklığa kavuşturmanın, kavramın konu edindiği alan ve kişileri korumak kadar ifade özgürlüğünün gerekçesiz ihlallerinin önüne geçilmesi bakımından da önemli olduğu düşünüldüğünden yazı; kritik bir pozisyonda kalmaya çabalarken, kavrama ilişkin uluslararası insan hakları belgeleri ve yerel hukuki düzenlemeleri ele alacaktır. Son olarak gerek tanımsal, gerekse hukuksal olarak yerleşik kesin bir çerçeveden yoksun olan kavram AİHM’si içtihatları dâhilinde irdelenecektir.

Where in freedom of expression is hate speech?
Öz: This paper aims to undertake hate speech - a conceptually debatable concept - to its relation to freedom of expression and accordingly search for the definition, content and interpretations of the concept. In this regard; the reference to the concept to define certain expression and actions, the position of the concept in relation to freedom of speech and what constitutes this position will be point at issue. Because it is considered to be important to define the concept in order to avoid unjustified limitations to freedom of speech along with protecting the individuals and areas that are subjected to hate speech; the paper will examine international and national human rights documents while trying to hold a critical position. Finally, the concept which lacks certain conceptual and legal frame, will be examined through the interpretations of ECHR case law.
