Karşılaştırmalı hukukta orman mülkiyeti
Öz: Orman kaynaklarının sürdürülebilirliği ve etkin kullanımı birçok faktöre bağlıdır. Bununla birlikte, ormanmülkiyeti bu faktörler arasında üzerinde en çok durulan ve tartışılan konu başlıklarından birisidir. Karşılaştırmalı hukukise farklı ulusların hukuk düzenlerini analiz etme, anlama ve mevcut hukuk sistemine ile ayrıştığı yönleribelirleyebilmek adına önemli bir araçtır. Bu çalışma ile orman mülkiyeti, karşılaştırmalı hukuk temelindeincelenmektedir. İncelemede, Kara Avrupası hukuk sistemini temsilen Fransa, Anglo -Sakson hukuk sistemini temsilenBüyük Britanya ve Sosyalist hukuk sistemini temsilen Rusya Federasyonu esas alınmıştır. Yapılan inceleme sonucundaKara Avrupası ve Anglo -Sakson hukuk siteminde özel orman mülkiyetinin yaygın olduğu, buna karşın Sosyalist Hukuksisteminde ise Devlet mülkiyetinin daha yaygın olduğu görülmektedir. Kara Avrupası ve Anglo -Sakson hukuksiteminde özel orman mülkiyetinin daha yaygın olması, mülkiyet hakkına dönüşen ve geçmişten gelen kullanım haklarıile yakından alakalıdır. Buna ek olarak, tarihi süreç göz önüne alındığında hukuk sistemi farkı gözetmeksizin ormanmülkiyet türlerinde birçok değişim yaşandığı da anlaşılmaktadır.

Forest ownership in comparative law
Öz: Efficient and sustainable use of forest resources depend on various factors. However, one of the mostemphasized and discussed topics among these factors is forest ownership. Comparative law is an important way ofanalyzing an d understanding legal systems of different countries, and identifying different aspects of the current legalsystems. This study tries to analyze forest ownership with regard to comparative law. France for the Continental-European legal system, Great Brita in for the Anglo -Saxon legal system, and Russia Federation for the Socialist legalsystem are taken respectively as a base. Thus, how right to ownership is evaluated in different legal systems and whatare the main features of that are indicated. As a resu lt, private forest ownership is common in the Continental-Europeanlegal system and Anglo -Saxon legal system while state ownership is common in the Socialist legal system. Prevalenceof private forest ownership in the Continental-European and the Anglo -Sax on legal systems is also closely related tothe previous use rights transferred into right to ownership. In addition, it is concluded regarding the historical processthat many changes occurred on forest ownership types without considering differences in legal systems.
