CRIMINALIZING THE DENIAL OF THE SO-CALLED ARMENIAN GENOCIDE AND ITS EXAMINATION UNDER FREEDOM OF EXPRESSION

Öz:
There is a new trend in European domesticlegislations to criminalize the denial ofgenocides and crimes against humanity whichstarted with specifically the criminalization ofthe denial of the Holocaust in several Europeancountries, and continued with the expansion ofcriminalization by the inclusion of genocidesand/or crimes against humanity in general,with the efforts to fight against hate speechacross Europe. However, making speech asubject of the criminal law as an offence bringssome problems as it also falls within the areaof another fundamental value of Europeandemocracies which is the freedom of expression.The purpose of this study is to demonstrate thedanger that criminalization of the denial of theso-called Armenian genocide poses to Europeandemocracies. In order to achieve that purpose,the analyse of genocide denial laws is made withthe inference that the main reasons behind thecriminalization of the Holocaust denial in Europewhich the European Court of Human Rightsalso described as a “clearly established fact”,is incapable of justifying the criminalization ofthe denial of the so-called Armenian genocide.This discussion is followed by the assessment ofthe possibility of the Switzerland Criminal Codewhich criminalizes the denial of genocides, tocause potential violence in the case of the denialof the so-called Armenian genocide, to reach theconclusion that criminalizing the denial of the socalled Armenian genocide seriously endangersthe enjoyment of freedom of expression inEurope

Sözde Ermeni Soykırımı İnkârının Cezalandırılması ve İfade Özgürlüğü Bağlamında Değerlendirilmesi

Öz:
Avrupa’da nefret söylemiyle mücadele kapsamında, Yahudi soykırımı inkârının birkaç ülkede cezalandırılmasıyla başlayan ve genel olarak tüm soykırım ve insanlığa karşı suçların cezalandırılmaya başlanmasıyla devam eden yeni bir süreç yaşanmaktadır. Bununla birlikte söylemlerin bir ceza hukuku konusu haline getirilmesi, başka bir Avrupa temel değeri olan ifade özgürlüğüyle çatıştığından sorunlara sebep olabilmektedir. Bu çalışmanın amacı, sözde Ermeni soykırımı inkârının cezalandırılmasının Avrupa demokrasileri yönünden teşkil ettiği tehlikeyi ortaya koymaktır. Bu doğrultuda öncelikle soykırım inkâr yasaları incelenerek Avrupa İnsan Hakları Mahkemesinin de “açıkça kanıtlanmış gerçeklik” olarak kabul ettiği Yahudi soykırımının inkâr edilmesinin Avrupa’da cezalandırılmasına ilişkin amaçların, sözde Ermeni soykırımı inkârını cezalandırmayı meşru kılamayacağı gösterilmeye çalışılacaktır. Daha sonra İsviçre Ceza Kanunu’nun genel olarak soykırım inkârını cezalandıran hükmünün, sözde Ermeni soykırımı söz konusu olduğunda potansiyel mağduriyete yol açma riski tartışılarak sözde Ermeni soykırımı inkârını cezalandırmanın Avrupa’da ifade özgürlüğünü ciddi biçimde tehdit ettiği sonucuna varılacaktır
