Yargı Bağımsızlığı

Öz:
Yargı bağımsızlığı, hukukun üstünlüğüne bağlı bir devlette temel ilkelerden birisidir. Kuvvetler ayrılığı ilkesine tabi bir demokraside yargının yasama ve yürütme erklerine karşı bağımsız olması gerekiyor. Türk anayasası bu gerçeği tanıyarak 138. maddesinde yargının bağımsız olduğunu açıklıkla belirtmiştir. Anayasa ayrıca bağımsızlığı güvence altına almak için hâkim ve savcıların atanmalarını ve meslekte yükselmelerini bağımsız bir hâkimler ve savcılar yüksek kuruluna bırakmıştır. Bu kurulun başkanı Adalet Bakanı, Adalet Bakanlığı müsteşarı da yasal üyesidir. Kalan beş üye ise Yargıtay ve Danıştay 'dan seçilen yüksek hâkimlerdir. Türkiye 'de uzun yıllardan beri Adalet Bakanlığı 'nın bu kuruldaki pozisyonu yoğun tartışmalara konu olmaktadır. Bu çerçevede yargının siyasi baskı altında olduğu iddia edilmektedir. Bu nedenle Adalet Bakanı ve müsteşarın kuruldan çıkarılarak yerlerini hâkimlere bırakmaları önerilmektedir. Yazar bu incelemesinde diğer demokratik ülkelerden örnekler vererek Adalet Bakanının kuruldaki konumunu haklı göstermeye çalışmaktadır.Bu bağlamda bakanın kurulda yer almasının kurula demokratik meşruiyet kazandırdığını ifade etmektedir.

The Independence of Judiciary

Öz:
The independence of judiciary is one of the basic principles of a state governed by the rule of law. In a democracy basing on the notion of the "separation of powers" the judiciary must be separated from the other powers, i.e. executive and legislature. Recognizing this fact the Article 2 of the Turkish Constitution defines the Republic as a democratic social and secular state governed by the rule of law. As to the independence of the judiciary Article 138 states that "Judges shall be independent in the discharge of their duties..." In order to secure the independence of the judiciary, the Constitution entrusts the initial appointments of judges and public prosecutors and their subsequent promotions to the Supreme Council of Judges and Public Persecutor. The Chairman of the Council is the Minister of Justice. The Undersecretary of the Ministry of Justice is also an ex-officio member of the Council. The remaining five members, constituting the majority of the Council are the members of the High Court for Appeal or the Council of State. In Turkey there is a long debate for years about the position of the Justice Minister as the President of the Council. It is claimed that the administration of Justice is under political pressure. Therefore, the Minister of Justice and the Undersecretary of the Ministry should be removed from the Council and replaced by the Judges. The author apposes to these kinds of criticisms and tries by hand of examples in other democratic countries to justify the position of the Justice Minister as its chairmanship. He considers among others the presence of the Minister as a democratic element with regard to the structure of the Council.
