KOVID-19 PANDEMİSİ: ULUSLARARASI HUKUK AÇISINDAN DÜNYA SAĞLIK ÖRGÜTÜ'NE İLİŞKİN BİR DEĞERLENDİRME

Öz:
Dünya Sağlık Örgütü (DSÖ) 1948'de kurulmuş olmakla birlikte arkasında 19. yüzyıl ortasına gidenbir deneyim bulunmaktadır. Bu deneyimin temelini de devlet sınırlarını aşan salgın hastalıklarla mücadelegereksinimi oluşturmaktadır. Ancak amaçları için gerekli olan finansal ve teknik olanaklar ile üye devletlerinişbirliği her zaman istenen düzeyde olmamaktadır. Finansal kaynakların yarısının belirli programlar için verilengönüllü katkılardan oluştuğu ve örgütün bağlayıcı hukuk kuralı geliştirmekten uzak durduğu görülmektedir.2005 Uluslararası Sağlık Tüzüğü ile Genel Direktör "Uluslararası Nitelikte Halk Sağlığı Acil Durumu" ilanetme yetkisi kazanmıştır. Yine Tüzük’le tüm salgın hastalıklarda üye devletlere bildirim yükümlülüğügetirilmiştir. Ancak üye devletlerin aşırı önlemlere maruz kalmak korkusuyla bunu yapmaktan kaçındıkları vemücadele için yeterli kapasite geliştiremedikleri görülmektedir.Örgütün tüm sorunlara ve kimi hatalara karşın, önceki salgınlardan edindiği deneyimle bu süreci doğruyönettiğini belirtmek gerekir. Ancak kimi eski kimi yeni ortaya çıkan eksiklere dair üye devletlerin bir reformagidip gidemeyeceğini zaman gösterecektir.

COVID-19 Pandemic: An Assessment of the World Health Organization From an International Law Point Of View

Öz:
Although the World Health Organization (WHO) was founded in 1948, it was based upon the experience of fighting against quarantinable diseases dating back to mid-19th century. Nevertheless, fulfilling its goals would require more financial and technical resources and collaboration from member states. Half of the financial resources are provided as voluntary contributions to support certain programmes, and the WHO is reluctant to develop binding rules of law. General Director is given one more power by International Health Regulations of 2005: Declaration of Public Health Emergency of International Concern (PHEIC). It also stipulates that member states must inform the organization in case of an epidemic. But states avoid from it with the fear of excessive measures, and they were not able to bring their health systems to the standard necessary to fight these diseases. Despite all challenges, limitations and some mistakes, the WHO managed to govern this crisis quite well by drawing upon its past experience and lessons learned from previous epidemics. Only time will tell whether member states will be able to make reforms deemed necessary.
