Uluslararası Hukukta Güvenlik Söylemleri: Uluslararası İlişkiler Teorileri İle Kesişen Düzlemler

Öz:
Uluslararası hukuk alanındaki teorik yaklaşım farklılıkları, Uluslararası İlişkiler teorilerindeki tartışmalarla ortak bir izdüşüme sahiptir. Söz konusu izdüşüme ışık tutması açısından, çalışma, sadece dönemsel değil öne çıkan teorik perspektifler için de geçerli olan paralelliği, güvenlik söylemleri örneğinde ele alacaktır. Henüz modern anlamda uluslararası ilişkilerden bahsedilemeyecek olan Doğa Hukuku doktrininin etkin olduğu ilk dönemde, güvenlik algısı devletin ülkesi ile sınırlı görülmemiş, tehditin konusu da egemenlik ile ilişkilendirilmemiştir. Geleneksel Uluslararası İlişkiler teorilerinin etkin olduğu ulus-devlet sisteminde uluslararası hukuktaki teorik tartışmalar pozitivist/realist hukuk ve karşıtları arasında gelişmiştir. Son dönem, her iki disiplinde de meta-teorik tartışmaların ön plana çıktığı, güvenliğin tanımı ve içeriğinin ötesinde bizzat güvenlikleştirmenin sorunsallaştırıldığı dönem olmuştur. Uluslararası hukukun Uluslararası İlişkiler teorileri ile ilişkisinin güvenlik söylemi üzerinden incelenmesi, sadece dönemler arasındaki fay hatlarını değil, kesişme noktalarını da açığa çıkaracaktır. Bu ilişki, sadece uluslararası hukuk teorilerinin değil aynı zamanda Uluslararası İlişkiler teorilerinin de içinde geliştiği ve etkin olduğu çevre ile olan bağlarını güvenlik bağlamında ortaya koyması açısından önemlidir.

Security Discourses in International Law: Intersecting Planes With International Relations Theories

Öz:
The theoretical debates in international law (IL) fall onto a parallel projection with those wthin the International Relations (IR) discipline. In order to display the close relationship between IL and IR, the paper attempts to exemplify the common security discourses producing not only periodic but also definitional and contextual coherence between the two disciplines. In its pre-modern form, the natural law doctrine in IL assumed security threats transcending state borders without limiting the subject of the threat to the premature and latent concept of sovereignty. With the rise of nation-state, and also in parallel to mainstream theories in IR, theoretical debates in IL developed around positivist/realist law and its critics. The most recent period has witnessed meta-theoretical debates in both disciplines which not only problematize the content and definition of security, but also furthers its inquiry as to the practice of securitization as such. In its quest of displaying the commensurability of theoretical debates in IR and IL, the paper illustrates how security discourses converge and recede between the two fields’ fault lines and intersections. Analysing the interaction between the two disciplines contributes also to our understanding of the role of the broader context in theorizing security
