ULUSAL EGEMENLİK VE ULUSLARARASI İŞBİRLİĞİ KONUSU OLARAK ULUSLARARASI ÖRGÜTLERDEN ÇIKMA VE ÇIKARILMA

Öz:

Uluslararası örgütlerden çıkma ve çıkarılma prensip olarak örgüt kurucu anlaşmalarında düzenlenen bir konudur. Uluslararası örgütün niteliği, gerçekleştirmek istediği amaçlar ve örgüt kurucu anlaşmasına taraf devletlerin iradesi bu çerçevede yapılan düzenlemede benimsenecek modele esas olmaktadır. Makalede benimsenen değişik modeller yanısıra örgüt kurucu anlaşmasında çıkma ve çıkarılma konusunda açık bir düzenlemenin bulunmaması halinde Viyana anlaşmalar hukuku sözleşmesinin konuya yaklaşımı açıklanmaktadır.

Öz:

Withdrawal and expulsion from the international organizations are regulated by the founding treaties of the organizations in principle. The nature and aims of the international organizations and the will of the participating states form basis for models to be adopted. This article examines the different models and The Vienna Convention on the Law of Treaties in case of absence of articles regarding withdrawal and expulsion in the founding treaties.
