Türkiye’de Yargı Kurumuna İlişkin Güven Algısını Etkileyen Faktörlerin Belirlenmesine Yönelik Bir Ölçek Geliştirilmesi
Öz: Diğer devlet kurumlarında olduğu gibi yargıya duyulan güven düzeyi, tümden siyasal sisteme (devlete) duyulan güven üzerinde de belirleyicidir. Yargının üçüncü bir devlet kuvveti olarak yasama ve yürütme karşısındaki ?hakem? rolü söz konusu belirleyiciliğin önemini daha da arttırmaktadır. Türkiye?de yargıya yönelik toplumsal güven düzeyine ilişkin güncel tartışmalar zaman zaman alevlenmektedir. Ancak bu tartışmaların hiçbiri güçlü bir akademik arka plana dayanmamakta, konjonktürel gelişmelere dayalı olarak gerçekleştirilen kamuoyu araştırmaları ile sınırlı kalmaktadır. Önerilen bu projenin başlıca amacı ?Türkiye?de yargı kurumunun toplum nezdindeki destek düzeyini güven unsuru ile ölçmeye yönelik geçerli ve güvenilir bir araç (ölçek) geliştirmektir. Bu çerçevede nicel bir araştırma yöntemi tercih edilmiştir. Bu kapsamda öncelikle bir literatür taraması yapılmış, yargıya güveni etkileyen/belirleyen faktörlerin teorik arka planı tespit edilerek bunlar bir madde havuzuna dönüştürülmüştür. 9 kişiden oluşan bir uzman paneli söz konusu maddeleri değerlendirmiş ve uygun görülen 38 madde listelenmiştir. Yapılan pilot çalışma sonrası madde listesinin güvenilirlik ve geçerliliği değerlendirilmiş ve revize maddelerden meydana gelen ölçek 35 maddelik bir soru formu ile 12 ilde 2139 kişiye uygulanmıştır. Elde edilen verilerle yapılan analizler sonrasında ?Türkiye?de yargı kurumuna ilişkin güven algısını etkileyen faktörler? ölçeği, ?siyasal güven?, ?yargının şeffaflığı ve hesap verebilirliği?, ?sosyal güven?, ?adalete erişim?, ?yargının bilinirliği / farkındalığı? biçiminde isimlendirilen 5 boyut altında yer alan 30 maddeden meydana gelmektedir.
