THE LEGAL REGIME OF THE ARCTIC REGION BASED ON UNCLOS AND THE POLAR CODE AND EVALUATION OF ITS EFFECTIVENESS

Öz:
One of the most popular issues of global maritime law is the legal regime of the Arctic Region. Hence not only the Arctic countries (Fin-land, Iceland, Sweden, Norway, Russia, US, Denmark/Greenland, and Canada) are concerned with the governance of the region. Due to espe-cially geopolitical and environmental reasons, today, most of the other countries do also desire to appear in the formation of the legal regime of the region. The study aims to point the problems concerning the legal regime of the Arctic Region based on UCLOS and the Polar Code and make suggestions to overcome these problems. Thus, in the study, the main features of the Arctic Region are determined in consideration with the concerning states, concerning international organizations and threats and challenges to the region. Thereafter, the legal regime of the region including the UNCLOS, the Polar Code and other concerned interna-tional conventions is explained. By considering the determined main features of and the explained legal regime for the Arctic Region, the effectiveness of the legal regime of the region is evaluated. Hence as the region is faced with important problems such as conflicting economic benefits, non-participation of the states to concerned conventions, vari-ous regional approaches, and national standards for safety, a uniform and binding legal regime is urgently needed.

Öz:
Küresel deniz hukukunun en gözde konularından biri de ArktikBölgesinin hukuki rejimidir. Nitekim bölgenin yönetimi ile sadece Arktikülkeleri (Finlandiya, İzlanda, İsveç, Norveç, Rusya, Birleşik Devletler,Danimarka/Grönland ve Kanada) ilgilenmemektedir. Özellikle jeopolitikve çevresel nedenler dolayısıyla, günümüzde, çoğu diğer ülke de bölgeninhukuki rejiminin oluşumunda varlık göstermek istemektedirler. Çalışmada,Arktik Bölgesinin UNCLOS ve Kutup Kodu ile temellendirilmiş hukukirejimi ile ilgili sorunları işaret etmek ve bu sorunları giderebilecekönerilerde bulunmak amaçlamaktadır. Bu nedenle, çalışmada, ArktikBölgesinin temel özellikleri; ilgili devletler, ilgili uluslararası örgütler vebölgenin karşı karşıya kaldığı tehdit ve mücadeleler dikkate alınmaksuretiyle belirlenmiştir. Bunu takiben, bölgenin temel hukuki rejimi;UNCLOS, Kutup Kodu ve diğer ilgili milletlerarası sözleşmelerkapsamında açıklanmıştır. Arktik Bölgesinin belirlenen temel özellikleri veaçıklanan hukuki rejimi dikkate alınmak suretiyle, bölgenin temel hukukirejiminin etkililiği değerlendirilmiştir. Nitekim bölgenin çatışan ekonomikmenfaatleri, ilgili milletlerarası sözleşmelere devletlerin taraf olmayışı,bölgesel yaklaşımlardaki farklılıklar ve emniyete dair kabul edilenulusal standartlar, yeknesak ve bağlayıcı bir rejimin ivedilikle kabulüihtiyacını ortaya çıkarmaktadır.
